Terms of use

These terms cover your use of detoured.co.za. They do not cover buying leads from us. Any lead purchase is governed by a separate written agreement or test spec.

Accepting these terms

By using detoured.co.za, you agree to these terms. If you don't agree, please don't use the site. If you use the site for a company, you confirm that you can accept these terms for it.

Who we are

This site is run by Detoured (Pty) Ltd ("Detoured", "we", "us"), a private company registered in South Africa. Our full company details are in section 14.

We do performance marketing and lead generation. We run paid social ads that bring US consumers and small-business owners to landing pages and forms we operate, where they ask to be contacted about personal, auto or business loans. We sell each lead to one US lender, broker or lead buyer.

What this site is for

detoured.co.za gives businesses information about our lead generation services. It is not an offer to sell leads, and nothing on it creates a contract.

If you buy leads from us, a separate written agreement or test spec sets out the lead types, volumes, prices, filters, delivery method, return rules and compliance duties. If that document and this site say different things, the document wins.

Prices, volumes, examples and descriptions on the site are a general guide and can change without notice.

No guaranteed results

Lead performance depends on things we don't control, including your offer, how quickly you call, your sales team, your lending criteria and the market. We don't promise any particular contact rate, conversion rate, number of funded loans or return on spend. Any figures or examples on the site describe what can happen. They are not a forecast of your results.

Intellectual property

We or our licensors own the content of this site, including the text, design, graphics and the Detoured name. You may view it and share links to it. You may print or save pages for your own business use, such as evaluating our services. You may not copy, republish, sell or adapt the content without our written permission.

Acceptable use

When you use the site, don't:

break any law or anyone else's rights;
try to gain unauthorised access to the site, its servers or any connected system;
introduce viruses or other harmful code, or try to overload or disrupt the site;
scrape or harvest content or data from the site with automated tools without our permission; or
pretend to be someone else, or give us false information when you contact us.

We may block access to the site for anyone who breaks these rules.

Third-party links and services

The site links to services run by other companies. For example, you can book a call through Cal.com. Those services have their own terms and privacy policies, and we are not responsible for their content, availability or how they handle your information. A link does not mean we endorse the other site.

Disclaimers

We try to keep the site accurate and available, but we provide it "as is". We don't promise that it will always be available, free of errors or free of viruses, or that its content is complete and up to date.

Nothing on the site is legal, compliance, financial or tax advice. You are responsible for making sure your own lead buying, calling and texting comply with the laws that apply to you, including the TCPA and state lending and privacy laws.

Limitation of liability

To the extent the law allows, Detoured and its directors, employees and contractors are not liable for any loss or damage arising from your use of this site or your reliance on its content. This includes direct, indirect and consequential loss, such as lost profit, lost business or lost data.

This does not limit liability that the law does not allow us to limit, such as liability for fraud or gross negligence. It also does not change anything in a separate written agreement or test spec between you and us. That document sets out each party's liability for leads.

Privacy

Our privacy policy explains how we handle personal information, including the information of people who book a call or email us.

Governing law

The law of the Republic of South Africa governs these terms and your use of the site. South African courts have jurisdiction over any dispute about them. If a court finds any part of these terms invalid, the rest still applies.

Changes to these terms

We may update these terms from time to time. The date at the top shows when we last changed them. The version on the site when you use it is the one that applies.
